1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Player", "User", "you") and 5mbw ("5mbw", "we", "us", "our"), the operator of the online gaming platform accessible at 5mbw.app and its associated mobile applications.

By accessing the 5mbw website, creating an account, making a deposit, or participating in any game or promotion offered on the platform, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety, together with our Privacy Policy and Responsible Gaming Policy, each of which is incorporated herein by reference.

If you do not agree to any part of these Terms, you must immediately cease using the 5mbw platform and close your account. Continued use of the platform following any update to these Terms constitutes your acceptance of the revised Terms.

2. Eligibility & Age Requirements

Access to and use of the 5mbw platform is subject to the following eligibility requirements, all of which must be satisfied at the time of registration and on a continuing basis throughout your use of the platform:

• You must be at least 21 years of age. Under Philippine law and PAGCOR regulations, participation in casino-style gambling is restricted to individuals aged 21 and above. 5mbw strictly enforces this requirement.
• You must be a natural person. Corporate entities, trusts, and other legal persons may not register as players.
• You must not be a resident of, or accessing the platform from, any jurisdiction where online gambling is prohibited by applicable law.
• You must not be a current employee, contractor, director, or officer of 5mbw, nor an immediate family member of any such person.
• You must not have been previously excluded or banned from the 5mbw platform or any affiliated platform.
• You must have full legal capacity to enter into a binding contract under the laws of the Republic of the Philippines.

5mbw reserves the right to request documentary proof of age and identity at any time. Acceptable documents include a valid Philippine government-issued ID such as a PhilSys National ID, passport, driver's licence, SSS ID, GSIS ID, PRC ID, or voter's ID. Failure to provide satisfactory proof of age may result in suspension or permanent closure of your account and forfeiture of any pending withdrawals.

3. Account Registration & Verification

3.1 Registration

To access the full range of 5mbw services, you must register a player account. You may only hold one active account on the 5mbw platform at any time. The creation of multiple accounts ("multi-accounting") is strictly prohibited and may result in the permanent closure of all associated accounts and forfeiture of balances.

During registration, you are required to provide accurate, complete, and current information including your full legal name, date of birth, residential address in the Philippines, email address, and Philippine mobile number. You must promptly update your account information if any details change.

3.2 Know Your Customer (KYC)

5mbw is required to conduct identity verification in accordance with applicable anti-money laundering (AML) regulations and PAGCOR compliance requirements. You agree to cooperate fully with the KYC process, which may include submission of:

• A valid government-issued photo ID (as listed in Section 2 above)
• Proof of residential address (utility bill, bank statement, or barangay certificate dated within 90 days)
• Proof of payment method ownership (e.g., screenshot of GCash or Maya account showing your registered name)
• Source of funds declaration where required by applicable regulations

Withdrawals may be withheld pending completion of KYC verification. 5mbw will not be liable for any delay in processing withdrawals caused by a player's failure to complete verification in a timely manner.

3.3 Account Security

You are solely responsible for maintaining the confidentiality of your 5mbw login credentials. You must not share your username, password, or two-factor authentication codes with any third party. Any activity conducted through your account will be deemed to have been authorised by you. If you suspect unauthorised access to your account, you must notify 5mbw immediately at [email protected].

4. Deposits & Withdrawals

4.1 Deposits

5mbw accepts deposits via the following payment methods available to Philippine residents: GCash, PayMaya/Maya, bank transfer (BPI, BDO, Metrobank, UnionBank, Landbank, PNB, Security Bank), and debit card. All deposits must be made from a payment account registered in your own name. Third-party deposits are strictly prohibited.

The minimum deposit amount is ₱100. Deposits are generally credited to your 5mbw wallet instantly or within a few minutes, depending on the payment method and network conditions. 5mbw does not charge fees on deposits, though your payment provider may apply their own charges.

4.2 Withdrawals

Withdrawal requests are processed to the same payment method used for the most recent deposit, subject to KYC verification being complete. The minimum withdrawal amount is ₱500. Processing times vary by payment method but are typically completed within one to three business days.

5mbw reserves the right to conduct additional security checks before processing any withdrawal. Withdrawals may be delayed or withheld if there is a reasonable suspicion of fraudulent activity, bonus abuse, or a breach of these Terms.

4.3 Currency

All transactions on the 5mbw platform are conducted in Philippine Peso (PHP / ₱). If your payment method operates in a different currency, conversion will be applied at the prevailing exchange rate at the time of the transaction.

5. Bonuses & Promotions

5mbw offers a range of bonuses and promotional offers to eligible players. All bonuses are subject to the specific terms and conditions published alongside each offer, which form part of these Terms. In the event of any conflict between a specific promotion's terms and these general Terms, the specific promotion terms shall prevail.

• Wagering Requirements: Bonus funds are subject to wagering requirements before they may be withdrawn. The applicable wagering multiplier will be clearly stated in the promotion terms. Failure to meet wagering requirements within the specified validity period will result in forfeiture of the bonus and any winnings derived from it.
• One Bonus Per Player: Unless otherwise stated, each promotion is available once per player, per household, per IP address, and per payment method.
• Game Contributions: Not all games contribute equally to wagering requirements. Slots typically contribute 100%, while live dealer games, bingo, and table games may contribute at a lower rate as specified in the promotion terms.
• Bonus Abuse: 5mbw reserves the right to void bonuses and withhold associated winnings if there is evidence of bonus abuse, including but not limited to: use of multiple accounts, use of third-party payment methods, low-risk betting strategies designed to circumvent wagering requirements, or collusion with other players.
• Modification and Withdrawal: 5mbw reserves the right to modify, suspend, or withdraw any promotion at any time without prior notice. Any bonus already credited to a player's account at the time of withdrawal will remain subject to the original promotion terms.

6. Gameplay Rules

All games available on the 5mbw platform are governed by individual game rules published within each game interface. By participating in any game, you agree to be bound by those rules. The following general gameplay terms apply across all 5mbw games:

• All game outcomes are determined by certified random number generators (RNGs) or, in the case of live dealer games, by physical dealing and spinning conducted by trained dealers under controlled conditions.
• 5mbw does not manipulate game outcomes. Return-to-player (RTP) percentages for each game are available within the game information panel.
• In the event of a technical malfunction during a game round, the round will be declared void and any wager placed will be refunded to your account. 5mbw's decision on technical malfunction disputes is final.
• Bets placed after a game round has commenced may be voided at 5mbw's discretion.
• Players are responsible for ensuring they have a stable internet connection before commencing play. 5mbw is not liable for losses resulting from disconnection during a game round, except where the platform itself is at fault.
• Sports betting markets are subject to separate sports betting rules published in the sports section of the platform. Settlement of bets follows the official result as declared by the relevant governing body (e.g., PBA, NBA, UFC, PCSO for sabong).

7. Prohibited Conduct

The following conduct is strictly prohibited on the 5mbw platform. Engaging in any prohibited conduct may result in immediate account suspension, permanent closure, forfeiture of balances, and referral to relevant law enforcement authorities:

• Registering more than one account on the 5mbw platform
• Providing false, misleading, or fraudulent information during registration or KYC
• Using the platform if you are under 21 years of age
• Using automated software, bots, scripts, or artificial intelligence tools to interact with the platform or gain an unfair advantage
• Exploiting software bugs, errors, or vulnerabilities in the platform or any game
• Engaging in collusion with other players to manipulate game outcomes
• Using the platform to launder money or conduct any other illegal financial activity
• Depositing funds derived from criminal activity
• Attempting to reverse, charge back, or dispute legitimate transactions with your payment provider
• Harassing, threatening, or abusing 5mbw staff or other players via any communication channel
• Accessing the platform from a jurisdiction where online gambling is prohibited

8. Responsible Gaming

5mbw is committed to promoting responsible gaming practices. We recognise that for a small number of players, gambling can become problematic. The following tools are available to all registered 5mbw players via the account settings panel:

• Deposit Limits: Set daily, weekly, or monthly limits on the amount you can deposit into your 5mbw wallet.
• Loss Limits: Set a maximum amount you are willing to lose within a defined period.
• Session Time Reminders: Receive notifications after a defined period of continuous play.
• Reality Checks: Periodic on-screen reminders displaying your net gaming activity for the current session.
• Self-Exclusion: Temporarily or permanently exclude yourself from the 5mbw platform. Self-exclusion periods range from 24 hours to permanent closure. Once a self-exclusion is activated, it cannot be reversed until the exclusion period has elapsed.
• Account Closure: You may request permanent closure of your account at any time by contacting 5mbw support.

5mbw will not knowingly allow a self-excluded player to access the platform. However, players who circumvent self-exclusion by registering a new account do so in breach of these Terms and will have any winnings forfeited.

9. Intellectual Property

All content on the 5mbw platform, including but not limited to text, graphics, logos, icons, images, audio clips, game software, and the overall look and feel of the platform, is the property of 5mbw or its content suppliers and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the 5mbw platform solely for your personal, non-commercial entertainment purposes. This licence does not include the right to:

• Copy, reproduce, distribute, or publicly display any content from the platform
• Modify, adapt, translate, or create derivative works based on platform content
• Reverse engineer, decompile, or disassemble any software component of the platform
• Use any data mining, scraping, or similar data extraction tools on the platform
• Frame or mirror any portion of the platform on any other website or application

Any unauthorised use of 5mbw intellectual property will result in immediate termination of your account and may give rise to legal action.

10. Privacy & Data Protection

5mbw collects, processes, and stores personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By registering an account, you consent to the collection and processing of your personal data as described in the Privacy Policy.

5mbw complies with applicable Philippine data protection laws, including the Data Privacy Act of 2012 (Republic Act No. 10173). Your personal data will not be sold to third parties. It may be shared with payment processors, KYC verification providers, and regulatory authorities where required by law.

11. Limitation of Liability

To the fullest extent permitted by applicable law, 5mbw shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the platform, including but not limited to:

• Loss of winnings or profits resulting from technical malfunctions, disconnections, or platform downtime
• Losses arising from your reliance on information published on the platform
• Unauthorised access to your account resulting from your failure to maintain the security of your credentials
• Delays in deposit crediting or withdrawal processing caused by third-party payment providers
• Any loss or damage arising from force majeure events including natural disasters, government actions, or telecommunications failures

5mbw's total aggregate liability to you for any claim arising out of or in connection with these Terms shall not exceed the total amount deposited by you into your 5mbw account in the 30 days preceding the event giving rise to the claim.

12. Termination & Account Closure

Either party may terminate the player account relationship at any time. You may close your account by contacting 5mbw support. 5mbw may suspend or permanently close your account at its sole discretion, including but not limited to the following circumstances:

• Breach of any provision of these Terms
• Failure to complete KYC verification within a reasonable timeframe
• Reasonable suspicion of fraudulent activity, money laundering, or other illegal conduct
• Receipt of a self-exclusion request from the account holder
• A regulatory or legal requirement to do so
• Extended account inactivity (accounts with a zero balance inactive for more than 12 consecutive months may be closed)

Upon closure of your account for reasons other than a breach of these Terms, any verified real-money balance remaining in your wallet will be returned to you via your registered payment method within a reasonable timeframe, subject to completion of any outstanding KYC requirements.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute arising out of or in connection with these Terms that cannot be resolved through good-faith negotiation between the parties shall be submitted to the exclusive jurisdiction of the competent courts of the Philippines.

Before initiating any formal legal proceedings, you agree to contact 5mbw's support team at [email protected] and allow a period of 30 days for the parties to attempt to resolve the dispute amicably.

Nothing in this clause shall prevent 5mbw from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction where necessary to protect its legitimate interests.

14. Amendments to These Terms

5mbw reserves the right to amend, update, or replace these Terms at any time. When material changes are made, 5mbw will notify registered players via email to the address on file and/or by displaying a prominent notice on the platform for a period of not less than 14 days prior to the changes taking effect.

Your continued use of the 5mbw platform after the effective date of any amendment constitutes your acceptance of the revised Terms. If you do not agree to the amended Terms, you must cease using the platform and may request account closure in accordance with Section 12.
